Submitting a Claim to The Financial Services Control
The client has the right to submit a claim within 45 days from the date of the incident; however, they must first address the claim to their broker.- According to the requirements of The Financial Services Control, the broker is obligated to acknowledge receipt of the claim within 5 days and to provide a response to the client's claim within 14 days.
- The client can submit a claim to The Financial Services Control only if they are not satisfied with the broker's decision or if the broker has not provided a response to the claim within 14 days.
Claim Analysis
The Financial Services Control will review the grounds for the claim and confirm whether the claim falls under its jurisdiction within 5 days.- The head of the committee will contact the client and the Partner Company to obtain the necessary information regarding the claim within 5 days of the claim submission. The possibility of resolving the claim during the analysis stage will also be considered.
- If the possibility of resolving the claim at the analysis stage is not available, the claim is forwarded to the Committee for review.
Review of the Claim
The Dispute Resolution Committee makes a decision on the claim based on the information obtained during the claim analysis stage.- If there is insufficient information to make a decision, the Committee will request the missing information from the parties within 7 days.
Decisions and Orders
The Committee's decisions are binding for the Partners. The Committee's decisions are binding for the client only if the client accepts them.- If the client agrees with the Committee's decision, they must provide written confirmation of their agreement within 14 days from the date of the decision. If the client does not confirm their agreement with the Committee's decision within the specified time frame, the claim is considered closed.
- The Partner is required to satisfy the claim according to the Committee's decision within 28 days from the date the decision is made.
- If the decision is in favor of the Partner, the client is required to provide a written withdrawal of the claim within 7 days, after which the claim is considered closed.
